Changes to self-assessment forms

We have made it simpler to apply for support online. Our needs assessment covers all areas of social care, including equipment, adaptations and sensory loss.

We have removed the ‘equipment, adaptations and mobility assessment’ and ‘sensory assessment’. If you have already started these forms, you can still submit them until 8 June.

Carers can still complete a carers assessment separately.

Deprivation of Liberty Safeguards (DoLS)

Important Update – DoLS Referrals

Managing Authorities are advised that, following the UK Supreme Court judgment of 2 June 2026 (UKSC 2025/0042), the legal test for identifying a deprivation of liberty has changed. The previous Cheshire West “acid test” has been overturned and replaced with a more individualised, multi-factor approach, including consideration of the person’s wishes, feelings, and potential for valid consent.

All new DoLS referrals submitted to East Sussex must reflect this updated legal position and be completed in line with the revised approach.

Further local guidance will be issued. In the meantime, Managing Authorities should continue to apply the Mental Capacity Act 2005 and seek advice where required.

What are the Deprivation of Liberty Safeguards (DoLS)?


If a person lacks mental capacity, it could be necessary to limit their freedom. Limiting a person's freedom in this way helps provide care and prevent them from harm. DoLS should limit a person's freedom as little as possible. Arrangements are assessed to check they are necessary and in the person's best interests. Representation and the right to challenge deprivation arrangements are other safeguards that are part of DoLS.
